Aerosmith singer Steven Tyler has been accused of sexual assault by several women.
A New York lawsuit accusing Steven Tyler of sexually assaulting a model in the 1970s was dismissed Wednesday, according to court documents reviewed by WECB.
Judge Lewis Kaplan found that plaintiff Jeanne Bellino’s case did not meet the criteria of New York’s Victims of Gender-Motivated Violence Protection Act because Ms. Bellino had not alleged that Steven Tyler had presented a ” serious risk of physical injury ” from his view.
“ We agree with the judge’s reasoning and are grateful for this outcome for our client “, declared to Reuters Mr. Tyler’s lawyer, David Long-Daniels.
Ms. Bellino’s lawyer, Jeff Anderson, argued that if ” Tyler’s attorneys filed the motion asking the Court to dismiss the lawsuit in early February, but failed to serve the motion on the victims as required by the Court’s rules to allow the plaintiff to file an objection “. He added that Ms. Bellino “ will ask the Court to reintroduce the legal action “. Mr. Anderson reiterated those assertions in a letter to the court Thursday, asking that the motion to dismiss be overturned.
In her complaint, Ms. Bellino claims that Mr. Tyler sexually assaulted her several times in one day when she met the Aerosmith singer in New York in 1975, when she was 17 and he was 27. She claims she was hospitalized and treated following the incident and still requires medication “ to cope with the sexual assault and suffered long-term physical injuries related to the trauma ”, almost fifty years later.
The lawsuit comes a year after Julia Misley, formerly Julia Holcomb, sued Steven Tyler in California, accusing him of sexually assaulting her when she was a teenager. In her complaint, Ms. Misley claims that Mr. Tyler began molesting her when she was 16, in 1973. He allegedly persuaded her parents to grant him guardianship over Ms. Misley, so that she could cross borders. the State with him without being subject to criminal prosecution. She also claimed that she was pregnant by him in 1975, when she was 17, and that he persuaded her to have an abortion. (The case is still ongoing).
